Does a person get injured in a car accident when the car sustains no damage? Unfortunately the auto insurance industry would of course say absolutely not — that since the car is visibly intact, there is no way your body could have sustained an injury. This is simply a generalization, but it is our experience that auto insurers try to avoid paying on a claim because there is little to no damage to the car. Who Pays For Medical Treatment After An Accident?

  • The State of Florida is a “No Fault” state, meaning your Auto Insurance pays for injuries sustained by you or any passengers regardless of who was at fault. Every driver is required to carry Personal Injury Protection (PIP) car insurance.
  • Florida requires that any treatment for accident-related injuries must occur within 14 days of the date of the accident, from a licensed provider (Physicians, Chiropractors, Nurse Practitioners, Physician Assistants, Registered Nurses, Dentists, or Emergency Medical Services). Once that window closes, your claim will not be accepted and you will not be eligible for PIP reimbursement.
  • All medical treatments, including medications, following an accident are covered by your auto insurance with NO out-of-pocket expense for the patient. Most Primary Care Physicians are not set up to bill auto insurance companies, so patients often pay out of pocket for those visits instead.
